By using Miwa.lol (the "Service"), you agree to these Terms of Service (the "Terms"). These Terms outline the rules and guidelines for using our website and services and form a binding agreement between you and Miwa.lol ("we," "us" or "our"). By accessing or using the Service in any way, you represent that you have read, understood, and agree to be bound by these Terms.

Welcome to Miwa.lol! These Terms of Service govern your use of our website and services. By accessing or using Miwa.lol, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use our Service.

• Age Requirement: You must be at least 13 years old to use Miwa.lol. If you are under the age of majority in your country, you may only use Miwa.lol with the consent and supervision of a parent or legal guardian.
• Global Access: Miwa.lol is available worldwide. However, by using our site, you confirm that using it does not violate any laws or regulations in your region.
• Account Requirements: Creating an account requires providing a username, email address, and password. You must ensure that this information is accurate and up-to-date. Impersonation or use of false information is strictly prohibited.

• Attempting to gain unauthorized access to our systems, other users' accounts, or computer networks
• Violating intellectual property rights of others
• Using automated tools (including bots, scrapers, or similar technologies) to access or interact with Miwa.lol in a way that overloads, interferes with, or circumvents normal operation of the Service, unless we have given you our prior written permission
• Reselling, sublicensing, or commercially exploiting any part of the Service without our prior written permission

You retain ownership of content you create and upload to Miwa.lol. However, by uploading content, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content as part of our services
• The right to moderate, remove, or refuse to display content that violates these Terms

You represent that you have all necessary rights to grant these licenses and that your content does not infringe on third-party rights.

All Miwa.lol content, including but not limited to logos, design, text, graphics, software, and trademarks, is owned by us and protected by intellectual property laws. You may not use, copy, modify, or distribute our content without explicit written permission.

Miwa.lol may contain links to or integrate with third-party services and content. We do not endorse, control, or assume responsibility for third-party content or services. Your interactions with third parties are solely between you and them.

We respect the intellectual property rights of others and expect our users to do the same. If you believe that content on Miwa.lol infringes your copyright, please contact us at [email protected] with a description of the work, the location of the infringing content, and your contact information. We will review valid notices and remove infringing content where appropriate. We may also terminate the accounts of repeat infringers.

If you choose to send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate that feedback without any obligation or compensation to you.

Miwa.lol offers optional paid products that provide access to additional features, items, or recognition. Current products and prices include:

• Premium: a one-time, lifetime payment of €5.99 that unlocks additional features and enhanced functionality.
• Verified: a one-time, lifetime payment of €29.99 that grants a verified badge and related perks.
• Custom Badge: €6.99 per badge.
• Credits: virtual currency used to buy items within Miwa.lol. Credits can be purchased with real money, and may also be earned for free by completing Quests or other in-app activities.

Prices may change over time, and the prices displayed at the time of purchase apply. All prices are listed in Euros (€) and include applicable taxes where required by law.

Credits, badges, shop items, and other virtual items have no monetary value, are not redeemable for cash, and remain part of the Service. We grant you a limited, personal, non-transferable license to use virtual items within Miwa.lol. Credits earned for free - for example, by completing Quests - may be subject to additional conditions, such as expiry or limits, and carry no purchase value. Some items may be time-limited and expire, and we may modify, manage, or remove virtual items where reasonably necessary.

Certain products, such as Premium and Verified, may be purchased as a gift for another user. Gifted products are subject to these Terms, and the recipient must hold an eligible account to receive them.

Payments are processed through secure third-party payment providers, including support for card and cryptocurrency payments where available. By making a purchase, you agree to the applicable provider's terms and conditions. We do not store your full payment details.

All purchases are final and non-refundable. Our paid products are one-time purchases that unlock access for the lifetime of your account, and access is granted immediately upon purchase.

• EU/EEA Users: Distance purchases normally carry a 14-day right of withdrawal. However, our paid products are digital content supplied immediately. By completing a purchase, you expressly request that performance begin right away and acknowledge that you lose your right of withdrawal once access has begun, which happens immediately upon purchase. As a result, purchases are not refundable.
• Credits and Consumed Items: Credits and virtual items, whether purchased or earned, are likewise non-refundable.
• Statutory Rights: Nothing in this section affects any mandatory legal rights you may have if a product is faulty or not as described, which cannot be excluded under applicable law.

We may make beta, experimental, or early-access features available. These features are provided "as is," may be incomplete or unstable, and may be changed or removed at any time without notice. We may also run experiments and A/B tests to evaluate and improve the Service.

We may add, change, suspend, or discontinue any part of the Service at any time. While we strive to keep Miwa.lol available, we do not guarantee uninterrupted access and are not liable for any unavailability, maintenance, or downtime.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that we deem harmful to Miwa.lol or its users. You may stop using the Service and request deletion of your account at any time, as described in our Privacy Policy. If we terminate your account for a violation of these Terms, you may lose access to your account, content, and any virtual items or credits associated with it, which are non-refundable as described in Section 5. Provisions that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, and indemnification - will continue to apply.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Miwa.lol, you consent to the collection and use of your information as described in our Privacy Policy.

• Service Availability: Miwa.lol is provided "as is" and "as available." We do not guarantee continuous access to the site and are not responsible for any interruptions.
• Limitation of Liability: To the maximum extent permitted by law, Miwa.lol is not liable for any indirect, incidental, or consequential damages resulting from your use of the website.
• No Warranty: We do not make any guarantees regarding the accuracy, reliability, or fitness of the content or services for any particular purpose.
• Consumer Rights: Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be limited or excluded under applicable law.

By using Miwa.lol, you agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the site or violation of these Terms of Service.

These Terms are governed by the laws of the European Union and the applicable laws of the member state in which Miwa.lol is established. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. Any disputes arising from these Terms will be resolved before the competent courts, without prejudice to any mandatory consumer protection rights available to you in your country of residence. If you are an EU consumer and we are unable to resolve a dispute with you directly, you may be entitled to use an alternative dispute resolution (ADR) body in your country; we are not, however, obliged to participate in such proceedings.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

We will review reports and take appropriate action, which may include removing content or restricting accounts.
• Language: These Terms are written in English. Translations may be provided for convenience, but in case of any conflict, the English version prevails.

We reserve the right to modify these Terms at any time. Changes will be announced in our Discord server. The updated Terms take effect when they are posted on Miwa.lol. Your continued use of Miwa.lol after the updated Terms are posted constitutes your acceptance of the changes.
